The Best of The Tablelands and www.bestofthetablelands.com.au website (referred to in these Terms & Conditions as the “Website“) is owned and operated by Trustee for Deep Blue Trust (“DBT”).

 

  1. The material on the Website, Best of The Tablelands FaceBook and Instagram pages or associated services you may access is copyright of DBT and/or other copyright owners.

 

  1. The Website, Best of The Tablelands FaceBook and/or Instagram pages or associated services is available for you to access conditional on your acceptance without alteration of these Terms & Conditions. By continuing to access the Website, Best of The Tablelands FaceBook and/or Instagram pages or associated services you are agreeing to these terms and our Privacy Policy.

 

  1. We reserve the right to change the Terms & Conditions at any time by publishing the new terms on the Website. Your use of the Website, Best of The Tablelands FaceBook and/or Instagram pages and associated services constitutes your acceptance of those terms. Should you object to any of our Terms & Conditions, your sole option is to immediately cease using the Website, Best of The Tablelands FaceBook and/or Instagram pages and associated services.

  1. provides the links to other sites as a convenience to you and the existence of a link to other sites does not imply any endorsement by DBT of the linked site; and
  2. is not responsible for the material contained on those linked sites.

 

  1. DBT does not warrant guarantee or make any representation that:
  1. the Website, or the server that makes the site available on the Internet are free of software viruses;
  2. errors and defects in the Website will be corrected.

 

  1. DBT is not liable to you for:
  1. errors or omissions in the Website, Best of The Tablelands FaceBook and/or Instagram pages and associated services, or linked sites on the Internet; or
  2. delays to, interruptions of or cessation of the associated services provided, or Website, or linked sites, whether caused through negligence of DBT, its employees or independent contractors, or through any other cause.

 

  1. By making any information available on or via the Website, Best of The Tablelands FaceBook and/or Instagram pages or associated services “INFO”, you:
  1. grant us permission to use, reproduce, edit and publish details as supplied to us by you;
  2. warrant that the INFO does not breach any laws; and
  3. unconditionally waive all moral rights (as defined by the Copyright Act 1968) which you may have in respect of the INFO.

 

  1. We reserve the right (but have no obligation) to:
  1. review, modify, reformat, reject or remove any information which you post, transmit or otherwise make available (or attempt to post, transmit or otherwise make available) that, in our opinion, violates the Terms & Conditions or otherwise has the potential to harm, endanger or violate the rights of any person; and
  2. monitor use of the Website, Best of The Tablelands FaceBook and/or Instagrams pages and store or disclose any information that we collect, including in order to investigate compliance with the Terms & Conditions or for the purposes of any police investigation or governmental request.


11. Changes & Severability 

  1. The Issuer may amend these Terms & Conditions where permitted by law. 
  2. If any part of these Terms & Conditions is found to be void, unlawful, or unenforceable then that part will be severable from the balance of these Terms & Conditions and the severed part will not affect the validity and enforceability of any remaining provisions.


12. Governing Law & Jurisdiction 

  1. You agree to the jurisdiction of the courts of the State of Queensland, Australia, to determine any dispute arising out of your engagement of services with DBT and/or these Terms & Conditions. 
  2. These Terms & Conditions will be governed by and interpreted in accordance with the law of the State of Queensland, Australia, without giving effect to any principles of conflicts of laws.


Buy Local & Save Coupon Book


1. General Terms 

  1. The “Buy Local & Save” Coupon Book (“Coupon Book”) contains promotional offers provided by independently owned participating local businesses (“Participating Businesses”). 
  2. The Coupon Book is issued by Best of The Tablelands (“Issuer”). 
  3. By purchasing, selling, distributing, or redeeming the Coupon Book, all parties agree to be bound by these Terms & Conditions. 
  4. All offers are subject to availability, trading hours, and any conditions imposed by the Participating Business, consistent with the Australian Consumer Law (ACL). 
  5. Coupons are promotional vouchers only and: 
      • Have no cash value
      • Are not redeemable for cash
      • May not be resold, copied, altered, or transferred unless expressly permitted 
  6. The Issuer is not responsible for lost, stolen, damaged, or expired Coupon Books, except where required under the ACL. 


2. Terms for Participating Local Businesses 

  1. Participating Businesses agree to honour the coupon offer exactly as published in the Coupon Book during the stated validity period. 
  2. Each Participating Business is solely responsible for: 
                            • The accuracy and clarity of its offer
                            • Providing the advertised goods or services
                            • Compliance with all applicable Australian and Queensland laws, including the ACL 
  3. Participating Businesses may impose reasonable conditions (such as one coupon per customer or per transaction), provided these conditions do not conflict with the printed offer. 
  4. A Participating Business may refuse to redeem a coupon if it is: 
        • Expired 
        • Altered, copied, or fraudulent 
        • Used in breach of the stated terms 
  5. The Issuer is not responsible or liable for: 
      • A Participating Business refusing to honour a coupon 
      • Business closures, changes of ownership, or withdrawal from the promotion 
  6. Participation does not create any partnership, agency, joint venture, or employment relationship between the Issuer and Participating Businesses. 


3. Terms for Coupon Book Buyers 

  1. Buyers are responsible for reading and understanding the terms, conditions, exclusions, and expiry dates applicable to each coupon prior to use. 
  2. Coupons must be presented at the time of purchase unless otherwise stated. 
  3. Coupons cannot be used in conjunction with other discounts, promotions, or offers unless explicitly permitted. 
  4. The Issuer does not warrant or guarantee the quality, safety, pricing, or availability of goods or services provided by Participating Businesses. 
  5. Any issues or disputes relating to goods or services must be resolved directly with the Participating Business, subject to the buyer’s rights under the Australian Consumer Law. 
  6. Refunds or replacements will not be provided for change of mind, unused coupons, or expired offers, except where required under the ACL. 


4. Terms for Retailers and Fundraising Organisations 

  1. Retailers and approved fundraising organisations (including schools, sporting clubs, charities, and community groups) are authorised to sell official, unaltered Coupon Books supplied by the Issuer. 
  2. The Coupon Book has a recommended retail price (RRP) of AUD $120 (inclusive of GST, if applicable). 
  3. Retailers and fundraising organisations must not: 
      • Alter, reproduce, or modify the Coupon Book 
      • Make representations or guarantees beyond those stated in the Coupon Book 
      • Sell the Coupon Book for more than the RRP
  4. Retailers and fundraising organisations are not responsible for: 
      • Redemption of coupons 
      • The conduct, availability, or performance of Participating Businesses 
  5. The Issuer is not responsible for Coupon Books that are lost, damaged, or stolen after delivery to the retailer or fundraising organisation. 
  6. Refunds or replacements will not be provided for change of mind, unsold Coupon Books, or expired Coupon Books, except where required under the ACL. 


5. Limitation of Liability 

  1. To the maximum extent permitted by law, the Issuer excludes liability for any loss or damage arising from: 
        • Acts or omissions of Participating Businesses
        • Refusal or inability to redeem a coupon
        • Business closures or changes 
  2. Nothing in these Terms & Conditions excludes, restricts, or modifies any consumer guarantee, right, or remedy available under the Australian Consumer Law.
